1. Acceptance of Terms

By accessing or using VisualEssential (“the Service”), operated by VisualEssential (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

VisualEssential is an AI-powered platform that generates music performance video clips from user-uploaded photos and audio. The Service uses artificial intelligence to place users into pre-designed visual scenes.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 13 years old to use the Service.

4. Subscriptions and Payments

Paid plans are billed monthly via Stripe. Your subscription renews automatically unless canceled before the renewal date. Refunds are handled on a case-by-case basis — contact us at support@visualessential.com. Credits expire at the end of each billing cycle and do not roll over.

5. User Content

You retain ownership of photos and audio you upload. By uploading content, you grant us a limited license to process it through our AI pipeline solely to deliver the Service. We do not sell or share your content with third parties. You represent that you have the right to upload all content you submit.

6. Generated Content and Ownership

Video clips generated by the Service are yours to use. Pro and Creator plans include commercial usage rights. Starter plan clips may be used for personal and promotional purposes. Free plan clips include a watermark and are for personal use only.

7. Acceptable Use

You agree not to:

• Upload content depicting minors or non-consensual imagery
• Use the Service to create defamatory, harassing, or misleading content
• Impersonate another person without their consent
• Attempt to reverse-engineer, exploit, or abuse the Service
• Resell or redistribute generated clips as a competing service

We reserve the right to suspend or terminate accounts that violate these terms.

8. AI-Generated Content Disclaimer

All clips are AI-generated and may contain visual artifacts or imperfections. We do not guarantee that generated content will be perfectly accurate, lifelike, or free of errors. You are responsible for reviewing generated clips before publishing.

9. Intellectual Property

The Service, including its design, AI models, scene templates, and branding, is the intellectual property of VisualEssential. You may not copy, modify, or distribute any part of the Service itself.

10. Limitation of Liability

The Service is provided “as is” without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your access at any time for violation of these terms. You may cancel your account at any time from your Settings page. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance. We will notify users of material changes via email or in-app notice.
